Agreement to Terms

By downloading, installing, or using HyperDevs (the "Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

HyperDevs is developed and provided by HyperDevs ("we", "us", or "our").

License Grant

We grant you a revocable, non-exclusive, non-transferable, limited license to use HyperDevs for personal or commercial purposes, subject to these Terms.

This license does not include:

  • The right to resell, redistribute, or sublicense the Software
  • The right to reverse engineer or modify the Software
  • The right to remove or alter any proprietary notices on the Software

Open Beta / Pre-Release Software

HyperDevs is currently provided as open beta, pre-release software for testing and evaluation purposes. By accessing or using it during this period, you acknowledge and agree that:

  • The Software is experimental, under active development, and may contain bugs, errors, or instability.
  • Features may change, break, or be removed at any time, and the Software may become unavailable without notice.
  • The Software may cause unexpected behavior, including loss or corruption of data, projects, or assets — you are responsible for backing up your work.
  • We provide no service-level guarantee, uptime commitment, or support obligation during the beta period.
  • You use the Software during the beta entirely at your own risk.

Acceptable Use

You agree to use HyperDevs only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Software to generate content that is illegal, harmful, threatening, abusive, or defamatory
  • Generate content that violates the intellectual property rights of others
  • Attempt to bypass security measures or rate limits
  • Use the Software to create malware, exploits, or harmful code
  • Spam or harass other users through any features of the Software
  • Use the Software in a way that disrupts its operation or infrastructure

We reserve the right to suspend or terminate your access if you violate these terms.

AI Provider Terms

HyperDevs integrates with third-party AI providers (Claude, Gemini, OpenAI, etc.). Your use of these providers is subject to:

  • Each provider's own terms of service
  • Each provider's acceptable use policy
  • Each provider's content guidelines

You are responsible for ensuring your use complies with all applicable AI provider terms.

Intellectual Property & AI-Generated Content

HyperDevs is a tool for generating content; we do not claim ownership of what you create with it. As between you and us, you are responsible for the prompts you enter and the images, 3D models, animations, and code you generate ("Generated Content").

  • You are responsible for ensuring your prompts and Generated Content do not infringe the intellectual property, privacy, or other rights of any third party.
  • Generated Content is produced by third-party AI models (such as Flux, TripoSR, Tripo3D, and Meshy) and is subject to each provider's terms and usage policies.
  • AI-generated output may not be eligible for copyright protection, and similar output may be produced for other users. We make no guarantee that Generated Content is unique or protectable.
  • You are responsible for confirming that your use of Generated Content complies with the Roblox platform's terms and all applicable laws.

HyperDevs — including its name, logo, software, and website — is owned by us and protected by intellectual property laws. Nothing in these Terms grants you rights to our branding.

Copyright Complaints (DMCA)

We respect intellectual property rights. If you believe content made available through HyperDevs Cloud infringes your copyright, send a notice to [email protected] that includes:

  • Identification of the copyrighted work you claim has been infringed
  • Identification of the material you claim is infringing, with enough detail for us to locate it
  • Your contact information (name, address, email)
  • A statement that you have a good-faith belief the use is not authorized
  • A statement, under penalty of perjury, that your notice is accurate and you are authorized to act for the rights holder
  • Your physical or electronic signature

We will respond to valid notices, may remove infringing material, and may suspend repeat infringers.

Roblox Integration

Trademark Notice:

HyperDevs is not affiliated with, endorsed by, or sponsored by Roblox Corporation. "Roblox" and "Roblox Studio" are trademarks of Roblox Corporation.

Any references to Roblox are for descriptive purposes only, to indicate compatibility with the Roblox platform.

HyperDevs Cloud Services

If you use HyperDevs Cloud (our hosted AI services), the following additional terms apply:

  • Usage & credits: HyperDevs Cloud is credit-billed. The Free tier receives a daily allowance of free credits that resets every 24 hours. The Pro tier (when available) receives a larger credit allowance along with priority access. Bring-your-own-key (BYOK) users who supply their own provider API keys are not subject to HyperDevs-imposed credit limits — usage on those keys is governed solely by the respective provider. Exact credit allowances may change during the beta; refer to the app for current figures.
  • Availability: We strive for 99% uptime but do not guarantee uninterrupted service.
  • Fair use: Excessive or abusive use may result in rate limiting or account suspension.
  • Payment: Paid tiers require payment through our payment processor. Refunds are handled case-by-case.

Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.

We do not guarantee that the Software will be error-free, uninterrupted, or meet your specific requirements. Use of the Software is at your own risk. We are not responsible for lost data, corrupted projects, or any damages resulting from use.

Limitation of Liability

To the maximum extent permitted by law, HyperDevs shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Lost profits or data
  • Damages exceeding the amount you paid (if any) for the Software

Some jurisdictions do not allow limitations on liability, so the above may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless HyperDevs and its operator from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Software; (b) the prompts you submit and the content you generate; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party, including intellectual property rights and the Roblox platform's terms.

Account Suspension

We reserve the right to suspend or terminate your access to HyperDevs or HyperDevs Cloud if:

  • You violate these Terms
  • You engage in fraudulent or abusive behavior
  • Your use poses a security risk to others or our systems
  • Required by law

We will provide notice of suspension unless doing so would exacerbate security issues.

Changes to These Terms

We may update these Terms from time to time. We will notify users of significant changes via the app or email. Continued use after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Colorado.
