Agreement to Terms

By downloading, installing, or using HyperDevs (the "Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

HyperDevs is developed and provided by HyperDevs ("we", "us", or "our").

Eligibility & Age Requirements

• Cloud accounts: 13 or older. You must be at least 13 to create a HyperDevs Cloud account. We ask for your date of birth at sign-up and this is enforced on our servers — if the date you provide indicates you are under 13, the account is not created.
• Purchases: 18 or older. You must be 18 or older to buy credits or a subscription. If you are under 18, do not make a purchase without the account holder's involvement.
• Under 13, or prefer not to register: you can use HyperDevs with your own AI provider keys ("BYOK") without an account. That mode requires no sign-up and is not subject to these age limits.
• If we learn that an account belongs to someone under 13, we will close it and delete the associated data.

License Grant

We grant you a revocable, non-exclusive, non-transferable, limited license to use HyperDevs for personal or commercial purposes, subject to these Terms.

This license does not include:

• The right to resell, redistribute, or sublicense the Software
• The right to reverse engineer or modify the Software
• The right to remove or alter any proprietary notices on the Software

Open Beta / Pre-Release Software

Acceptable Use

You agree to use HyperDevs only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Software to generate content that is illegal, harmful, threatening, abusive, or defamatory
• Generate content that violates the intellectual property rights of others
• Attempt to bypass security measures or rate limits
• Use the Software to create malware, exploits, or harmful code
• Spam or harass other users through any features of the Software
• Use the Software in a way that disrupts its operation or infrastructure

We reserve the right to suspend or terminate your access if you violate these terms.

AI Provider Terms

HyperDevs integrates with third-party AI providers (Claude, Gemini, OpenAI, etc.). Your use of these providers is subject to:

• Each provider's own terms of service
• Each provider's acceptable use policy
• Each provider's content guidelines

You are responsible for ensuring your use complies with all applicable AI provider terms.

Intellectual Property & AI-Generated Content

HyperDevs is a tool for generating content; we do not claim ownership of what you create with it. As between you and us, you are responsible for the prompts you enter and the images, 3D models, animations, and code you generate ("Generated Content").

• You are responsible for ensuring your prompts and Generated Content do not infringe the intellectual property, privacy, or other rights of any third party.
• Generated Content is produced by third-party AI models (such as Flux, TripoSR, Tripo, and Meshy) and is subject to each provider's terms and usage policies.
• AI-generated output may not be eligible for copyright protection, and similar output may be produced for other users. We make no guarantee that Generated Content is unique or protectable.
• You are responsible for confirming that your use of Generated Content complies with the Roblox platform's terms and all applicable laws.

HyperDevs — including its name, logo, software, and website — is owned by us and protected by intellectual property laws. Nothing in these Terms grants you rights to our branding.

Copyright Complaints (DMCA)

We respect intellectual property rights. If you believe content made available through HyperDevs Cloud infringes your copyright, send a notice to dmca@hyperdevs.app that includes:

• Identification of the copyrighted work you claim has been infringed
• Identification of the material you claim is infringing, with enough detail for us to locate it
• Your contact information (name, address, email)
• A statement that you have a good-faith belief the use is not authorized
• A statement, under penalty of perjury, that your notice is accurate and you are authorized to act for the rights holder
• Your physical or electronic signature

We will respond to valid notices, may remove infringing material, and may suspend repeat infringers.

Roblox Integration

HyperDevs Cloud Services

If you use HyperDevs Cloud (our hosted AI services), the following additional terms apply:

• Two separate limits. Hosted AI chat is metered as a daily request allowance that resets every 24 hours (the Free tier currently allows 15 requests per day). Image, 3D and animation generation is billed in credits, which are a separate balance you buy — new accounts start with a credit balance of zero, and credits do not replenish daily. Exact figures may change during the beta; the app shows the current ones.
• Bring-your-own-key (BYOK): if you supply your own provider API keys you are not subject to HyperDevs-imposed request or credit limits — usage on those keys is governed solely by the respective provider, and you pay that provider directly.
• Credits expire 6 months after they are granted. Each purchase or grant creates its own balance with its own expiry date, measured from when it was granted — not from when you last used the app. Spending draws from the balance closest to expiring first. Expired credits are removed automatically and are not refundable or restorable. The app shows a notice after credits have expired.
• Credits are not money. They are a prepaid allowance for use inside HyperDevs. They have no cash value, cannot be redeemed for cash, and cannot be transferred or sold.
• We may reverse credits granted in error — for example a gift issued to the wrong account, a duplicated grant, or credits obtained through fraud or a reversed payment.
• Availability: We aim for high availability but do not guarantee uninterrupted service. Some hosted models run on a single shared machine and serve one user at a time; when another user holds it you may be queued or asked to try again later, and sessions have a maximum length and an idle timeout. We do not guarantee capacity, concurrency, or a particular model remaining available.
• Fair use: Excessive or abusive use may result in rate limiting or account suspension.
• Payment: Purchases are processed by our payment processor; we do not receive or store your card details. Refunds are handled case-by-case — contact us and we will look at it.

Disclaimer of Warranty

Limitation of Liability

To the maximum extent permitted by law, HyperDevs shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Lost profits or data
• Damages exceeding the amount you paid (if any) for the Software

Some jurisdictions do not allow limitations on liability, so the above may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless HyperDevs and its operator from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Software; (b) the prompts you submit and the content you generate; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party, including intellectual property rights and the Roblox platform's terms.

Account Suspension

We reserve the right to suspend or terminate your access to HyperDevs or HyperDevs Cloud if:

• You violate these Terms
• You engage in fraudulent or abusive behavior
• Your use poses a security risk to others or our systems
• Required by law

We will provide notice of suspension unless doing so would exacerbate security issues.

Automated content screening

Prompts sent to our hosted image, 3D and animation generation are screened against our content policy before the request is forwarded. A prompt that fails is refused, and the refusal is recorded against your account.

• Suspension can be automatic. A severe violation, or a small number of repeated ones, suspends the account without a human reviewing it first. We keep the threshold deliberately low because of the age of the Roblox audience.
• You can appeal. If you believe a refusal or suspension was wrong, email legal@hyperdevs.app and a person will review it. Automated decisions are not final.
• What happens to your credits. Suspension does not itself cancel or forfeit unspent credits. However, a suspended account cannot spend them, and credits continue to expire on their normal 6-month schedule while suspended — so a long suspension can result in credits expiring unused. If we suspend an account in error we will restore or re-issue any credits that expired during it.
• Screening does not mean we read your work. It is applied to the prompt at the moment of the request; we do not retain your prompts or generated output. A refused prompt is recorded as a short excerpt and a reason, which is what lets us review an appeal.

Changes to These Terms

We may update these Terms from time to time. We will notify users of significant changes via the app or email. Continued use after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Colorado.
